2. Eligibility for Refund

You may be eligible for a full or partial refund under the following circumstances:

  • The project has not yet commenced, and the cancellation request is received in writing within 14 calendar days of payment.
  • VectronovaDynamics fails to deliver the agreed-upon scope of work within the timeframe specified in the contract, and no extension has been mutually agreed upon.
  • The delivered work materially deviates from the specifications outlined in the project agreement, and reasonable revision requests have not been addressed within 30 calendar days.

3. Non-Refundable Items

The following are not eligible for refunds:

  • Work that has been approved and delivered in accordance with the project specifications.
  • Third-party costs incurred on your behalf (e.g., domain registrations, hosting fees, stock assets, licensing fees).
  • Services rendered under a completed milestone that have been accepted in writing.
  • Change-of-mind cancellations after work has commenced beyond the initial consultation phase.

4. Requesting a Refund

5. Dispute Resolution

Terms of Service

1. Acceptance of Terms

By accessing and using the services provided by VectronovaDynamics (hereinafter referred to as "the Company"), located at Calle López de Hoyos 387, 1 Izquierda, Madrid, Spain, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.

2. Scope of Services

VectronovaDynamics provides digital studio services including but not limited to brand identity design, web development, UI/UX design, motion graphics, SEO optimisation, and cloud infrastructure deployment. The specific scope, deliverables, timelines, and pricing for each project will be defined in a separate written agreement or proposal accepted by both parties.

3. Client Obligations

The client agrees to:

  • Provide accurate, complete, and timely information necessary for the execution of the project.
  • Respond to requests for feedback or approval within the agreed-upon review periods.
  • Ensure they have the legal right to provide any materials, content, or assets submitted to VectronovaDynamics.
  • Make payments in accordance with the payment schedule outlined in the project agreement.

4. Intellectual Property

Unless otherwise agreed in writing:

  • All intellectual property rights in the work produced by VectronovaDynamics shall transfer to the client upon receipt of full payment for the relevant deliverables.
  • VectronovaDynamics retains the right to display completed work in its portfolio and marketing materials unless the client requests otherwise in writing.
  • The client warrants that any materials provided to VectronovaDynamics do not infringe upon the intellectual property rights of any third party.

5. Payment Terms

  • Invoices are payable within 14 calendar days of issue unless otherwise agreed in writing.
  • Projects may require an upfront deposit of 30-50% before work commences, as specified in the project agreement.
  • Late payments may incur interest at a rate of 8% per annum above the European Central Bank base rate, in accordance with EU Directive 2011/7/EU on late payments in commercial transactions.
  • VectronovaDynamics reserves the right to suspend work on a project if payments are not received within the agreed timeframe.

6. Limitation of Liability

To the maximum extent permitted by applicable law:

  • VectronovaDynamics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use our services.
  • The total liability of VectronovaDynamics for any claims arising from a project shall not exceed the total fees paid by the client for that specific project.
  • VectronovaDynamics is not responsible for delays or failures in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, government actions, or internet disruptions.

7. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of a project. This obligation survives the termination of the contractual relationship for a period of two (2) years.

8. Termination

Either party may terminate a project agreement with 14 calendar days' written notice. In the event of termination:

  • The client shall pay for all work completed up to the date of termination.
  • VectronovaDynamics shall deliver all completed work product to the client within 10 business days of the termination date.
  • Any outstanding deposits shall be refunded for work not yet commenced.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Spain and, where applicable, the European Union. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.

10. Changes to These Terms

VectronovaDynamics reserves the right to modify these Terms of Service at any time. Changes will take effect upon posting on this page with an updated revision date. Continued use of our services after such changes constitutes acceptance of the revised terms.
